Aer Lingus Careers Portal Privacy Notice

Aer Lingus is committed to protecting your personal information and to respecting your privacy. 

In this Notice, the terms “we”, “us” or “our” refers to Aer Lingus Limited (see “Controller of Personal Data” below).  As used in this Notice, the terms “personal data” and/or “personal information” mean information that identifies job applicants and potential candidates for employment with us submitted as part of the Aer Lingus Careers online portal (whether submitted directly by the individual applicant or via a third party recruitment firm) and/or through alternative channels (although please note all applications submitted otherwise are redirected for re-submission to us on the Aer Lingus Careers Portal). We will process your personal data in accordance with this Notice, unless such processing conflicts with the requirements of applicable law, in which case, applicable law will prevail.

This Privacy Notice (the “Notice”) describes our practices regarding the collection, use, transfer, disclosure and other processing of your personal data in connection with our recruiting processes; essentially what personal information we collect, how we collect it, what we use it for and who we share your personal information with in connection with our recruiting processes  This includes when you search for or apply for a job with Aer Lingus and use our Careers Portal website https://www.aerlingus.com/careers/. 

 

Who does this notice apply to? 

 

This Notice only applies to the personal data of job applicants, potential candidates for employment, and our optional recruiting programmes and events. It does not apply to our employees, contractors or customers, or other personal data that we collect for other purposes.

 

By submitting your personal data to us, you acknowledge that:


  1. You have read and understood this Notice and agree to the use of your personal data as set out herein.
  2. You are not required to provide any requested information to us, but failing to do so may result in not being able to continue your candidacy for the job for which you have applied.
  3. All of your representations are true and correct to the best of your knowledge and belief, and you have not knowingly omitted any related information of an adverse nature. Providing any inaccurate information may make you ineligible for employment.
  4. Your personal data may be transferred and processed worldwide, including countries that may not be deemed to provide the same level of data protection as your home country, for the purposes and in the manner specified in this Notice.
 
This Notice does not form part of any contract of employment offered to candidates hired by Aer Lingus.

Controller of Personal Data

Any personal data processed by Aer Lingus (or its third-party recruitment partners and service providers) in connection with this Notice is controlled by Aer Lingus Limited as the “data controller” under the General Data Protection Regulation (EU 2016/679) (“GDPR”) and any amending or replacement legislation. What types of personal information do we collect and process? 

We will only collect personal information in the recruitment process that is necessary to assess you for the vacancy you applied for. We may collect and process the following categories of information:

  • Information you provide in order to register for a personal account (“User Profile”) on our Careers Portal, for example your name, email address and home address;
  • Information you provide in order to apply for a job vacancy with Aer Lingus, such as your application, CV, name, address, contact details, professional qualifications, previous employment history, personal interests and experiences;
  • Information collected by Aer Lingus as part of the recruitment process, such as, and where applicable, results of psychometric testing, notes of interviews or in other assessments, information provided by your referees, decisions to offer employment, outcome (pass/fail) of Background Checks and aviation security checks including Garda Vetting;
  • Information related to your use of our Careers Portal. This information may be collected by using cookies. For more information about how Aer Lingus uses cookies please see our Cookie Policy. 

Some of the information we request may be mandatory and will be indicated with an asterisk (*). If you do not provide mandatory information you may not be able to create a User Profile and we may not be able to process your job application.   

Do we collect ‘sensitive personal information’?

Certain categories of personal information such as that about race, ethnicity, religion, health or criminal convictions are considered “sensitive personal information” under data protection law. There will be circumstances where we collect and process sensitive personal information as part of the recruitment process. For example, we may ask you for, or you may volunteer, details of medical conditions in order to make arrangements for you to attend an interview or assessment centre or because we need to be aware of certainmedical conditions in order to assess your suitability for a particular role. 

You may be required to provide information on criminal convictions and other matters for the purpose of aviation security checks to airport authorities. Aer Lingus is not the controller of that data. 

What do we use your personal information for?

The main purposes for which we use your personal information are to support and process any job applications you make to Aer Lingus. For example, to assess your ability to meet the job specification, to shortlist applicants and to verify references and professional qualifications provided by those applicants (see ‘Background Checks’ below for more information). 

We may also use your personal information to learn about and improve the experience of users of the Careers Portal and applicants seeking to work at Aer Lingus, including equal opportunities monitoring.  

Background Checks 

We may verify personal data you provide during the recruitment process and/or collect personal data from sources other than you to assist in the Background Checks process. This is the process whereby we collect and verify background information covering a 5-year period, as well as reference checks. If this occurs, you will be told in advance which aspects of your personal data will be verified and when.

You may also be required to provide information and answer any questions needed to complete aviation security checks into your personal history, criminal record and any other checks required for this role. The aviation security checks include Garda Vetting. Aer Lingus does not carry out these aviation security checks and is not the controller of that data; you will provide that information to the airport authorities directly and they will be the controller of that data. Aer Lingus will receive the outcome (pass/fail) of those checks.   

If a third party source advises that they require your consent prior to any Background Checks or reference checks being carried out, Aer Lingus will contact you to obtain/provide consent.

Background checks and reference checks are applied to all roles and are targeted at the collection of specific rather than general information.

What is the legal basis for processing your personal information? 

Aer Lingus will only process your personal information where we have a legal basis for doing so. In each case the legal basis will be one of the following:  
  • To decide whether to enter into a contract of employment with you: Where you have applied for a job and we need to use your personal information to determine whether we will enter into a contract of employment with you. This will be the legal basis for which we use your personal information in the majority of situations and will cover the use of your personal information from the initial application, through to the assessment centre and to interview. 
  • When it is in the legitimate business interests of Aer Lingus: Where it is necessary, as the operator of a commercial airline and recruiter, to understand our applicants in sufficient detail in order for us to deliver an effective recruitment service. For example, we may engage the use of analytics in order to provide insights so that we can improve, maintain and manage relationships with applicants and attract talented individuals to work with us; 
  • To comply with our legal obligations: where we are subject to a legal obligation. For example, we may be required by law to have our cabin crew, pilots and staff who require airside clearance carry out aviation security checks. 

Who do we share your personal information with? 

We use third party service providers in order to conduct and manage recruitment. For example, we may share your personal information with these service providers in order to conduct psychometric testing and/or interviews screening and verification of your application and the information you have provided to Aer Lingus. This includes verifying academic and professional qualifications and references. Individuals performing administrative functions and IT personnel within Aer Lingus may also have a limited access to your personal data to perform their jobs. We use third party service providers to provide a recruiting software system. We also share your personal data with other third party service providers that may assist us in recruiting talent, administering and evaluating pre-employment screening and testing, and improving our recruiting practices. 

There may also be situations where we have to share your personal information where we receive a valid request from law enforcement or other government authorities.  
 
A note on International Transfers: we put in place processes designed to ensure that any processing of personal data by third party service providers is consistent with this Notice and protects the confidentiality, availability, and integrity of your personal data. Where required by law, we put in place legal mechanisms designed to ensure adequate data protection of your personal data in a third country (i.e. a country outside the European Economic Area). Security
 
We have in place generally accepted standards of technical and operational security to protect personal data from loss, misuse, alteration, or destruction. Only our authorized personnel and those of our third party service providers are provided access to personal data, and these employees and third party service providers are required to treat this information as confidential. 

How long do we keep your personal information for? 
 
We will keep your personal information for no longer than is necessary to fulfil the purpose for which it was collected. This means that the period of time we keep your personal information will vary depending on the reason you provided your personal information to us.   
If you accept an offer of employment by us, any relevant personal data collected during your pre-employment period will become part of your personnel records and will be retained in accordance with the Aer Lingus staff privacy notice. If we do not employ you, we may nevertheless continue to retain and use your personal data for a period of time (up to 18 months) for system administration purposes, to consider you for potential future roles, and to perform research. Thereafter, we retain a minimum amount of your personal data to record your recruiting activity with us.  If you elect to join a recruiting programme, we may retain your personal data to consider you for future employment opportunities and for a period of time specific to that programme, unless you decide to discontinue your participation prior to such time.

Your Rights 

You have the right to request access to, rectification or erasure of, the personal informationAer Lingus holds about you. You may also have the right to object to or restrict certain types of processing of your personal information and request to receive a machine-readable copy of the personal information you have provided to Aer Lingus (in the same format).  

You can view the personal information you provided in order to register for a personal account on a self-service basis by logging into your User Profile on the Careers Portal. You may also edit or delete your own User Profile on the Careers Portal.  

Alternatively if you wish to access other personal information we hold about you or exercise any other rights you can put your rights request in writing and include the following information with your request: 
  • Your name and postal address
  • The email address used for the relevant application  / your User Profile (as applicable)
  • Details of your request

You must also provide: 
  • A photocopy of your passport or driving licence, so that we can verify your identity
  • Proof of address (e.g. utility bill) dated within the last 6 months
  • If you are applying on behalf of another person then signed authority from the individual is required

Any request to exercise one of these rights will be assessed by Aer Lingus on a case by case basis. There may be circumstances in which we are not legally required to comply with your request because of relevant legal exemptions provided for in data protection legislation. If you wish the information to be provided to you in a machine-readable copy please indicate that at the time of making your request.

Automated decision-making

You will not be subject to decisions that will have a significant impact on you based solely on
automated decision-making, save for the exemptions to this rule i.e. if automated decision making
is required or authorised by law or is necessary for entering into or performing the
contract or is based on your individual explicit written consent.
